유학 수속 및 이민, 정착 서비스 표준 약관

Standard Terms and Conditions for International Studying Agency Service

제 1조 (목적) | Article 1 (Purpose) 

본 약관은 저스트 에듀케이션(이하 “유학원”이라 합니다)과 유학 수속을 의뢰한 고객(이하 “고객”이라 합니다)간의 권리와 의무를 규정하고 서비스 제공의 범위를 명확히 설명하는 것을 목적으로 합니다.

This agreement is intended to regulate the rights and obligations between Just Education (hereinafter referred to as the "The Agency") and the client (hereinafter referred to as the "Client") who has commissioned study abroad procedures. It aims to clearly define the scope of service provision.

제 2조 (유학서비스의 제공 범위) | Article 2 (The Scope of Service for International Studying) 

유학원은 직영하는 “밴쿠버 헤럴드 어학원”, “써리 및 버나비노스의 리딩게이트” 또는 파트너 학교에서 제공하는 각종 어학연수, 초중고등학교의 정규 교육과정, 코업 및 직업관련 프로그램, 대학(교) 및 대학원 과정 등 고객이 필요로 하는 교육과정에 관한 안내, 등록대행, 사후관리 등의 서비스를 제공합니다.
The agency provides services such as guidance, registration assistance, and post-management related to various language training programs(ESL), public or independent primary and secondary schools, co-op and vocational  programs offered by directly operated institutions such as "Herald Language College Vancouver" and "Reading Gate Surrey and Burnaby North campuses," as well as partner schools and academies. These services cover the educational courses required by clients, including college, university and graduate programs.

제 3조 (대행 업무 절차) | Article 3 (Procedure of Agency Services)

1.     상담, 학교정보, 교육과정, 관련비용, 학업계획, 일정 등에 대한 안내
Counseling for school information, curriculum, tuitions, study plans, visa matters, etc.

2.     학교 수속을 위한 입학원서 작성, 유학 관련 서류 번역, 학교 수속
Filing applications, document translation for admission

3.     학비 안내, 납부, 입학허가서 수령
Collecting tuition invoice, guidance for payment, and receiving letter of acceptance(LOA)

4.     비자 서류 준비안내, 서류 번역 및 비자신청, 비자발급 업무대행 학비, 수업비 등
Preparation of visa(Study permit) application, supporting documents collection, document translation

5.     현지 숙소 배정 등에 관한 사항
Seeking local accommodation such as homestay, Airbnb, or long-term leasing

6.     출국 준비, 입국절차 등에 대한 안내
Pre-departure presentation, guidance on immigration process to Canada

7.     입국 오리엔테이션
New comer orientation and introduce local community

제 4조 (수수료) | Article 4 (Agency Fees)

1.     학교 등록을 위한 대행 수수료는 해당 학교에서 지불하므로, 고객은 무료입니다. 다만, 일부 수수료를 제공하지 않는 학교에 등록을 진행할 경우 소정의 수수료를 부과합니다.
The agency registration fee for school enrollment is paid directly to the respective school, so there is no charge for the client. However, if enrolling in schools that do not offer certain fees, a certain fee may be charged.

2.     본 계약을 진행하기 위한 계약보증금(60만원 또는 CAD $600)이 발생하나, 이 비용은 서비스 종료 시점에 환불 또는 기타 잔금비용에서 차감해 드립니다.
A contract guarantee deposit (KRW 600,000 or CAD $600) is required to proceed with this contract, but this cost will be refunded or deducted from other remaining costs upon the completion of the service.

3.     비자 대행을 위한 컨설팅 및 안내는 무료로 제공하나, 정부납부수수료, 신체검사, 공증 등에 관한 비용은 고객의 부담입니다.
Professional fees such as consulting and guidance for visa processing are provided free of charge, but the client is responsible for government fees, medical examinations, notarization, and related expenses.

4.     미성년 자녀의 학생비자 발급 및 학교 수속을 위한 가디언(Custodianship) 선임 비용은 CAD $2,000이며, 학생비자(Study Permit) 의 유효기간 동안 유지됩니다.
The cost of appointing custodianship for minor students for study permit and school registration is CAD $2,000, valid for the same period as the study permit.

5.     추가적인 미성년 자녀의 생활 관리와 학업 컨설팅은 월CAD $800이며, 최소 5개월(1학기) 단위로 계약할 수 있습니다.
The additional service for intensive care and academic consulting for minor student is CAD $800 per month, however, it must be contracted in a minimum of ONE SEMESTER (5 months).

6.     현지 정착을 위한 랜딩서비스는  CAD $3,000이며, 사전 집구하기, 공항 마중, 현지 운전면허증 교환, 은행 및 휴대전화, 인터넷 등 계좌 개설, 첫날 장보기, 교육청 등록, 사후 생활 도우미의 서비스를 제공합니다.
Landing services for local settlement are CAD $3,000, providing services such as pre-arranging housing, airport pickup, exchanging local driver's license, opening bank and mobile phone accounts, shopping on the first day, registering with the education office, and local assistance after arriving.

제 5조 (유학원의 의무) | Article 5 (Agency's Obligations) 

1.     유학원은 고객의 입장에서 소홀함이 없도록 주의와 의무를 다하여야 합니다.
The agency must sincerely take care and duty to ensure no negligence from the client's perspective.

2.     유학원은 모든 업무처리 절차에 대해서 정확한 정보와 자료를 투명하게 제공하여야 합니다.
The agency must provide accurate information and transparent documentation for all procedures.

3.     추가 비용이 발생하는 경우에는 사전에 고객의 동의를 반드시 구해야 합니다.
In case of additional costs, prior consent from the client must be obtained.

4.     유학원을 통해 각종 학비, 주거비 등의 비용을 고객으로부터 전달받아(해외 송금 등을 포함합니다) 납부하게 되는 경우, 특별한 사유가 없는 한 지체없이 납부를 완료하여야 합니다.
When the agency receives certain expenses such as tuition and accommodation fees from the client for payment (including wire transfer or current exchange), the agency must promptly complete the payment unless there are reasonable explanation for delay.

5.     유학원은 고객과 학교 또는 다른 관련자 사이에 분쟁이 발생할 경우 고객의 편에서 도와야 합니다.
In the event of disputes between the client and the school or other related parties, the agency must assist the client's side.

제 6조 (고객의 의무) | Article 6 (Client's Obligations)

1.     고객은 유학 수속과 비자 준비 과정에서 사실인 정보를 정확하게 제공하여야 합니다.
Clients must provide accurate and truthful information during the admission and visa preparation.

2.     고객은 수업료, 보증금 등 유학 수속과정에서 청구된 비용을 기한내에 납부하여야 합니다.
Clients are required to pay all fees, such as tuition and deposits, within the invoice due date.

3.     고객은 입학수속과 비자업무를 진행함에 있어서 유학원이 안내한 절차와 방법을 준수하여야 합니다.
Clients must adhere to the procedures and methods guided by the agency during the admission and visa application processes.

4.     입학수속과 비자업무에 있어서 고객이 제출한 모든 서류는 사실에 부합되고 적법하게 발급된 것이어야 합니다.
All documents submitted by clients for admission and visa processes must be truthful and lawfully issued.

5.     출입국절차, 각종 계약의 체결 등에 있어서 유학원이 이행 또는 자제를 강력하게 권고하는 경우 고객은 최대한 유학원의 권고에 따라야 합니다.
In matters such as immigration procedures and signing agreements, if the agency strongly recommends compliance or abstention, clients should follow the agency's recommendations.

제 7조 (계약의 체결 및 성립) | Article 7 (Effectiveness of the Contract)

고객은 유학원이 청구한 보증금 또는 학비 등을 지불함으로써 본 유학서비스의 계약이 체결되며, 계약사항은 서비스의 종료 또는 상호 합의에 의한 해지시까지 유지됩니다.
The client enters into a contract for this service by paying the deposit or tuition fees invoiced by the agency, and the terms of the contract will remain in effect until the completion of the service or termination by mutual agreement.

제 8조 (계약해지 및 손해배상) | Article 7 (Termination and Reimbursement)

1.     고객은 유학원이 제 5조에 명시된 의무를 위반한 경우에는 계약을 해지할 수 있으며, 이로 인하여 손해가 발생하였을 경우에는 손해배상을 청구할 수 있습니다. 유학원이 대행 업무를 하는 동안 업무 처리의 오류가 없음을 입증하지 못하는 경우, 계약을 해지하고 이미 지급한 유학원 수수료 전액의 반환 및 손해배상을 청구할 수 있습니다.
If the agency violates the obligations specified in Article 5, the client can request to terminate the contract, and if loss occur, the client can claim their damages. If the agency cannot prove that there were no faults in the handling of the business during the agency, the client can terminate the contract and claim a full refund of the agency fees already paid.

2.     유학원은 고객이 제 6조에 명시된 의무를 위반한 경우에는 계약을 해지할 수 있으며, 이로 인하여 유학원에게 손해가 발생한 경우에는 학생에게 손해배상을 청구할 수 있습니다. 이미 유학원이 수령한 유학 수속 대행 등의 각종 수수료, 유학 수속 보증금 등과 고객에 대한 손해를 상계할 수 있습니다.
If the client violates the obligations specified in Article 6, the agency can terminate the contract, and if damages occur to the agency, the agency can claim its loss. The agency can offset the agency fees, visa agency fees, deposit, and damages against the client that have already been received.

제 9조 (유학원의 면책) | Article 8 (Agency's Exemption) 

유학원은 다음의 각호에 해당하는 경우에는 책임을 지지 않습니다

The agency is not responsible in the following cases:

1.     고객이 제출한 서류 등이 사실과 어긋나거나 적법하게 발급되지 아니하여 발생한 손해 및 취소
If the documents submitted by the client to the agency are untrue or illegally issued, resulting in failure

2.     고객이 유학원과 협의한 기간 이내에 서류를 제출하지 않아 불이익이 발생한 경우
If the client does not submit documents within the deadline, resulting in disadvantages

3.     고객의 개인적 실수, 고객 개인의 사유로 인해 비자 발급이 거부된 경우
If the visa is refused due to the client's mistakes, personal faults

4.     고객의 어학 능력 부족에 의하여 입학이 취소되거나 지연되는 경우
Due to insufficient language ability for the required language for the programs, or courses

5.     고객의 불법 행위, 실수 또는 단순 변심에 따라 계약된 프로그램을 취소하게 되는 된 경우
If the client abandons prematurely due to illegal acts, client's mistakes, or personally changed mind

위 각호에 해당되더라도 유학원에 책임이 있는 사유로 이루어진 경우에는 유학원의 면책 사유가 되지 않습니다. 이때에 고객은 유학원에 책임 사유를 설명하고 그 사실을 입증해야 합니다.

Even in the above cases, if the agency is responsible for the reasons, the agency is not exempt from liability. In this case, the client must explain the reasons for the agency's responsibility and prove the facts.

제 10조 (환불규정) | Article 9 (Refund Policy)

1.     고객의 사정에 의해서 계약이 중도에 취소되는 경우, 유학원의 진행보증금은 환불되지 않습니다.
The security deposit for agency service will not be refunded in any case of termination by client

2.     학비는 등록하신 교육기관의 환불 규정에 따라 적용됩니다.
The refund of tuition will be applied according to the refund policy of the enrolled educational institution.

3.     주택 임대차 보증금, 기타 계약금 등의 환불은 관련 법률과 규정에 따라 적용됩니다.
The refund of housing lease security deposits, and other contract fees, will be applied in accordance with relevant laws and regulations.

제 11조 (분쟁의 해결) | Article 11 (Resolution of Disputes)

1.     이 약관과 관련된 분쟁에 관한 소송은 청구인이 지정한 국가의 법원에서 진행할 수 있습니다.
Litigation related to disputes arising from this agreement may be conducted in the courts of the country

2.     본 계약의 변경 또는 수정은 유학원과 고객이 서면으로 합의하여야 합니다.
Any changes or modifications to this agreement must be agreed upon in writing by the agency and the client.

3.     본 약과에서 규정하지 않은 사항은 당사자간의 합의에 의해 해결하거나, 합의되지 아니할 경우에는 관계법령 및 거래 관행을 고려하여 신의성실의 원칙에 따라 유학원과 고객이 합의하여 해결합니다.
Matters not specified in this agreement will be resolved by mutual agreement between the agency and the client or, if not agreed upon, in accordance with applicable laws and trade practices, considering the principles of good faith.

4.     본 계약과 관련된 법률상 분쟁이 발생한 경우에는 유학원과 학생은 소비자기본법 또는 다른 법률에 따른 분쟁조정기구에 분쟁조정을 신청하거나 중재법 또는 다른 법률에 따라 운영중인 중재기관에 중재를 신청할 수 있습니다.
In the event of a legal dispute arising from this standard terms and conditions, the agency and the student may apply for dispute resolution to a dispute resolution body under the Consumer Basic Act or other laws, or apply for mediation to a mediation institution operated under the mediation law or other laws.
